Terms of Service — Verbatim

By using Verbatim, you agree to these terms. Please read them — they're written to be understood, not to confuse.

1. About Verbatim

Verbatim is an AI-powered communication coaching platform operated in Australia. These Terms of Service ("Terms") govern your use of our website, application, and any related services (collectively, "the Service").

2. Eligibility

You must be at least 16 years old to use Verbatim. By creating an account, you represent that you meet this requirement. If you are using Verbatim under an Enterprise plan on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@verbatim.ai if you suspect unauthorised access.

You may not create accounts for others without their consent, share accounts, or use the Service to impersonate another person.

4. Acceptable use

You agree not to:

Use the Service for any unlawful purpose
Upload content that is harmful, defamatory, or violates another person's rights
Attempt to reverse-engineer, scrape, or extract the AI models or data underlying the Service
Use automated tools to access the Service at scale without our written permission
Resell or redistribute the Service without our written agreement

5. Your content

You retain ownership of any content you create or upload, including session recordings and transcripts. By using the Service, you grant Verbatim a limited licence to process this content for the purpose of providing you with coaching feedback and analytics.

We do not use your session content to train general-purpose AI models without your explicit opt-in consent.

6. Subscription and billing

Paid plans are billed in advance on a monthly or annual basis. Prices are in Australian dollars and include GST where applicable. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and no refunds are issued for partial periods.

We reserve the right to change pricing with 30 days' notice to subscribers.

7. Not clinical advice

Verbatim is a professional development and coaching tool. It does not constitute clinical, therapeutic, or psychological advice. If you are experiencing significant anxiety or distress related to communication, we encourage you to speak with a qualified health professional.

8. Limitation of liability

To the maximum extent permitted by Australian law, Verbatim's liability for any claim arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

9. Termination

We may suspend or terminate your account if you breach these Terms. You may delete your account at any time from your account settings.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

11. Changes

We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the Service after changes constitutes acceptance.
